How Long Does a Family Law Modification Take in Tennessee?

Family law matters can be complex and needs can change over the years. You may have gotten a child custody or support order a few years ago, but maybe things have changed. Or perhaps you got divorced and were ordered to pay alimony, but think you should not have to anymore now that your ex is living with someone else.

When Can You Request a Modification in Tennessee?

In Tennessee, you can modify a court order if you can prove that there has been a substantial or material change in circumstances. Spousal support orders that are modifiable can be modified if there has been a significant change in the circumstances of either party, such as a change in income or ability to work. Orders regarding child custody and parenting time can be modified if there has been a substantial or material change in circumstances that affects the child’s well-being.

Orders for child support can also be modified if there are changes in income, expenses, or the needs of the child. However, suppose it has been less than two years since the case was last reviewed. In that case, the party requesting the modification is required to provide the caseworker with information indicating a change in circumstances in cases where the child support office is involved.

How the Modification Process Works in Tennessee

So you may wonder: how long does the process take? A modification is not something that will happen overnight. Certain modifications can be done without going to court if both parties reach a mutual agreement on the new terms. However, for the changes to be legally binding and enforceable, they typically require judicial approval.

Generally, the process involves filing a petition to modify, serving the other parent, and then either reaching an agreement or having a court hearing to determine if a modification is warranted. You may need to attend hearings and possibly mediations as well if you and the other party cannot agree quickly.

It can take at least several months to get through all the steps. Under federal law, Tennessee courts are required to complete reviews and adjustments of child support orders within 180 days, or six months.

Cooperation is Key

The more cooperation, the better. If the parties involved can agree on the changes and cooperate, they can often resolve the issues more quickly, possibly within a few months. However, in cases of modifications, one party is greatly impacted financially. It is not likely that they will soon agree to a lower support amount.

These cases are often contested. This means that the parties will have to go to court to get them resolved. Getting a resolution could take many months and even longer than a year.
