How do I get an uncontested divorce?

Marriage doesn’t always work out. If you and your spouse agree on getting a divorce on the ground of irreconcilable differences and both of you agree on the terms of the property division, child custody/visitation, child support, and spousal support of the divorce, you can file for an uncontested divorce. An uncontested divorce is much simpler and can be finalized after 60 days without children and 90 with children. You may even waive your court appearance in Rutherford County in most cases.

What happens in a contested divorce?

Contested divorces are cases where there is not an agreement as to property division, child custody/visitation, child support, and spousal support. A contested divorce requires you to file a complaint for divorce asserting a fault-based ground and serving the complaint on your spouse after which they will have 30 days to file an answer.

The information you gather during discovery procedures is used to support your grounds for divorce as well as your specific requests regarding the terms of the divorce. Likewise, your spouse will use information gathered during discovery to contest your grounds and/or your requested divorce terms.

After discovery, the court will require mediation if no settlement has been reached. Also, if you have children, you will be required to attend a parent education class. If the contested issues are not resolved at mediation, the court will schedule your trial and the judge will make a ruling on all contested issues.
